Terms of Service

Last updated: to be confirmed before launch

1. Who we are and what these terms cover

These terms govern your use of the Hopp applications and website ("Hopp", the "Service"), operated by Hopp Apps ("we"). By using the Service you agree to them. If you do not agree, do not use the Service.

2. What Hopp is — and is not

Hopp is a media player. It plays video and audio streams from playlists and accounts that you supply. We do not provide, sell, host, index, recommend, or link to any content, channels or playlists, and we have no relationship with any content provider. What you add to Hopp is your choice and your responsibility.

3. Your content and your responsibility

You confirm that you have the right to access and play every playlist, stream and account you add to Hopp, in the country where you use it, and that doing so does not infringe anyone's rights or break any law or contract. We cannot see what you add — it is encrypted on your device — so we cannot and do not check it. If you are not sure you are entitled to content, do not add it.

4. Accounts

You may use Hopp without an account. An account is needed only for paid plans, for syncing between devices, and for continuous multi-device use. You may create an account only if you are 16 or older, or if a parent or guardian consents to it on your behalf. You must give accurate information, keep your password and recovery code safe, and tell us promptly if you believe your account has been compromised. Keep your recovery code: if you lose both your password and your recovery code, your synced data cannot be recovered by anyone, including us, because we never hold the key.

5. Plans, trial and payments

5a. Right of withdrawal (EU/EEA consumers)

If you are a consumer in the EU/EEA, you have 14 days from the day you buy a paid plan to withdraw from the purchase without giving a reason. To withdraw, use the online withdrawal route in your account, send us the withdrawal form below, or tell us in any other clear statement — a phone call or a reason is never required, and nothing is offered to you in exchange for staying before your request is honoured. If you withdraw, we refund you using the same means of payment you paid with, within the period the law requires; how much of your payment is refunded is stated on the checkout page and in your confirmation, because it depends on whether you asked the plan to start immediately and, if so, how much of the period you had used when you withdrew. Withdrawing ends your paid plan at your device's next check with our servers; it never deletes or hides a playlist, favourite, setting or downloaded item stored on any of your devices — you simply return to the free plan described in section 5.

Model withdrawal form. A form you can use for this, available in the app and on our website, is one option among several: you may equally withdraw using our online withdrawal route or by any other clear statement.

6. Acceptable use

You must not use Hopp to infringe intellectual property or other rights, to circumvent access controls or content protection, to interfere with the Service or other users, to reverse engineer or resell it, or in breach of any law. You must not share an account beyond the personal use described in section 5.

7. Notices of infringement

We respond to notices about content accessible through the Service in accordance with our notice-and-takedown process, available in the app and on our website. Our designated agent for notices is to be confirmed before launch. Because we neither host nor can read the content you add, our ability to act is limited to what the process describes.

8. Suspension and termination

You can stop using Hopp at any time and delete your account in Settings. We may suspend or terminate accounts that breach these terms, after notice where the law requires it. On termination, your encrypted sync data is deleted immediately and account records within 30 days, as described in the Privacy Policy.

9. Changes to the Service and to these terms

We may change the Service over time. We may change these terms; for material changes we will tell you in the app before they take effect, and if you do not agree you may stop using the Service and, where the law provides, cancel a subscription.

10. Disclaimers

The Service is provided "as is". We do not guarantee that any particular stream or playlist will work: whether a stream plays depends on its provider, its format and your device, none of which we control. To the extent permitted by law, we exclude warranties not stated here.

11. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for the content you add or its providers. Nothing in these terms limits liability that cannot be limited by law, including your statutory rights as a consumer.

12. Governing law

These terms are governed by the laws of the Netherlands. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and may bring proceedings there.
